chalkcloset.com (“chalkcloset,” “we,” “our,” or “us”) respects intellectual property rights and expects users to do the same. This policy explains how we handle copyright complaints under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512.
This policy applies to all user-generated content on our Services (listings, photos, descriptions, shop names, reviews, messages, and any files you upload).

1) Our Role & Your Responsibilities
- Marketplace: chalkcloset.com hosts content posted by users (buyers/sellers).
- You must own or have permission to use everything you post. Upload only original photos/descriptions or material you are licensed to use.
- No circumvention: Do not remove watermarks or bypass technical protection measures.

3) How to Submit a DMCA Takedown Notice (Copyright Owner or Authorized Agent)
Your notice must include all items below (17 U.S.C. §512(c)(3)):
- Your signature (physical or electronic).
- Identify the copyrighted work you claim is infringed (or a representative list for multiple works).
- Identify the infringing material to be removed or disabled, and provide specific URLs or enough information to locate it.
- Your contact information: name, mailing address, telephone, and email.
- Good-faith statement: that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- Accuracy & authority statement: that the information is accurate and that you are the copyright owner or authorized to act for the owner, under penalty of perjury.

Incomplete notices may be rejected or delayed while we request more information.
4) What Happens After We Receive a Proper Notice
- We will expeditiously remove or disable access to the identified material.
- We will notify the user who posted it and share the notice (including your contact info).
- We may ask for additional detail to locate content if URLs are unclear.
- We may terminate accounts that repeatedly infringe (see Section 7).
- We may preserve and share information as needed to comply with law or protect our rights.
5) How to Submit a DMCA Counter-Notice (User Who Posted the Content)
If your material was removed and you believe it was a mistake or a misidentification, you may submit a Counter-Notice. It must include (17 U.S.C. §512(g)(3)):
- Your signature (physical or electronic).
- Identify the material that was removed and the location (URL) before it was removed.
- Good-faith statement that you believe the material was removed or disabled as a result of mistake or misidentification.
- Your contact information: name, mailing address, telephone, and email.
- Jurisdiction consent statement: that you consent to the jurisdiction of the Federal District Court for your judicial district (or any district where chalkcloset.com is located if you are outside the U.S.), and that you will accept service of process from the person who provided the original notice (or their agent).

6) What Happens After We Receive a Proper Counter-Notice
- We will forward your counter-notice to the original complainant.
- We may restore the material within 10–14 business days after forwarding the counter-notice unless the complainant informs us they filed a court action seeking to restrain you from infringing the work.
- During this period, the content will generally remain disabled.
7) Repeat Infringer Policy
In accordance with the DMCA, we may terminate accounts in appropriate circumstances if they are deemed repeat infringers. As guidance (not a promise of specific thresholds), we may treat three (3) valid DMCA notices within a 12-month period as grounds for termination, but we may act sooner for egregious violations (e.g., willful infringement, evasion, CSAM indicators, or legal risk).
We may also remove related listings, block re-uploads, and restrict features to prevent ongoing infringement.
8) Subpoenas, Disclosures, and Law Enforcement
We may disclose user information in response to valid legal process, including DMCA §512(h) subpoenas, court orders, or other lawful requests. We also cooperate with law enforcement where required or appropriate.
9) Misrepresentations & Abuse of the DMCA
Submitting false or bad-faith notices or counter-notices can result in liability for damages (including costs and attorneys’ fees) under 17 U.S.C. §512(f). Only submit a DMCA notice if you have a good-faith belief and the legal right to do so.
10) Standard Technical Measures
We accommodate and do not interfere with standard technical measures recognized by the online content industry that are used by copyright owners to protect works, provided they do not impose substantial costs or burdens.
11) Trademark, Right of Publicity, and Other Complaints
The DMCA covers copyright only. For trademark or right of publicity issues, contact [email protected] with:
- your identity and authority,
- the mark/persona at issue,
- specific URLs,
- an explanation of the violation, and
- supporting evidence.
We will review under our Terms and applicable laws.
12) Guidance for Sellers (Best Practices)
- Use your own photos or assets you have clear permission to use (license, written consent).
- Keep proof (original files, licenses, emails).
- Avoid using brand logos, event graphics, catalog images, or watermarked photos unless you have rights.
- Promptly remove any listing if a rights holder contacts you and you agree there’s an issue.
13) Changes to this Policy
We may update this Policy from time to time. The “Last updated” date reflects the latest version. Material changes may be announced on-site.
